1. Acceptance of Terms
By accessing or using 12am, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Damian Francis ("12am").
2. Eligibility
You must be at least 13 years of age to use 12am. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.
3. The Platform
12am is a social platform designed for authentic, late-night expression. The core posting window is midnight to 5:00 AM local time. This constraint is intentional — 12am is built for the unfiltered thoughts, emotions, and connections that emerge in those quiet hours.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@12am.app of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Content Standards
You are solely responsible for the content you post. You agree not to post content that: • Is illegal, harmful, threatening, abusive, harassing, or defamatory • Infringes any intellectual property or privacy rights • Contains sexual content involving minors • Promotes violence, self-harm, or dangerous activities • Is spam, phishing, or deceptive • Violates any applicable local, national, or international law We reserve the right to remove any content that violates these standards without notice.
6. Heals, Whispers & Releases
"Releases" are posts you share with the community. "Whispers" are comments on releases. "Heals" are expressions of support (similar to likes). By posting any content, you grant 12am a non-exclusive, royalty-free license to display and distribute that content within the Service.
7. Privacy Settings
You may set your account to public or private. Private accounts require approval before others can follow you and see your content. You are responsible for managing your privacy settings. Blocking, restricting, and reporting tools are provided to help you control your experience.
8. Prohibited Conduct
You agree not to: • Impersonate any person or entity • Collect or harvest user data without consent • Use automated bots or scrapers • Attempt to gain unauthorized access to any part of the Service • Interfere with the proper functioning of the platform • Use the Service for commercial solicitation without authorization
9. Intellectual Property
The 12am name, logo, design, and all original content created by us are protected by intellectual property laws. You retain ownership of content you create, but grant us the license described in Section 6. You may not use our trademarks or branding without written permission.
10. Disclaimers
12am is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the accuracy or completeness of user-generated content.
11. Limitation of Liability
To the fullest extent permitted by law, 12am and Damian Francis shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date and, where appropriate, through in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or courts of competent jurisdiction.
